Food Safety Atlas

Food safety by country

Malaysia has one federal rulebook, with a Ministry of Health (MOH) registration and a local authority licence side by side. The Food Hygiene Regulations 2009 cover registration, premises, handlers and food protection. The Malay text of the Act is authoritative.

Changes are close. From 1 December 2026, P.U. (A) 227/2026 removes the medical examination (vaccination stays) and adds supervision training for mass catering. From 1 March 2027, imported food must come from premises under an MOH-recognised . Confirm current text with MOH.

Ministry of Health
Administers the Food Act through its Food Safety and Quality Programme. It registers premises, runs voluntary schemes, and has inspection, improvement and closure powers.
Local authorities
Issue a separate food premises licence under local by-laws, and inspect. Their environmental health officers can be under the Act.
Halal authorities
JAKIM and State Islamic Religious Councils certify halal. Halal is voluntary, but any halal claim must be certified and carry the logo.

Getting permission to operate

Check you are in scopeRegistration covers manufacturing, catering or mass catering, premises where food is prepared, stored or served for sale, and vehicles selling food.
Register with MOHApply online through FoSIM. The lasts up to 3 years. Renew at least 30 days before expiry, and display it.
Hold the local authority licenceThis is separate. Rules and fees come from the local by-law, so check with the council where the premises sit.
Train and vaccinate food handlersEvery handler needs the training from an MOH-approved school, and vaccination by a registered medical practitioner (anti-typhoid in MOH practice).
Keep traceability and recordsOne step up and one step down, with records available to officers on request.
Add a programme if you manufactureManufacturing premises must keep a on site.

Food service supervision training (reg 30A)Anyone who engages in or supervises mass cateringLaw from 1 December 2026. "Mass catering" is not defined in the regulations.
A plan is not always law
Food service has no duty to hold a documented programme under reg 9. Customers or schemes may still ask for one. This is the sharpest contrast with New Zealand and with catering in Singapore.
Warmer chilled limit
The regulations allow food stored for retail sale at −1 to 10 °C. Australia and New Zealand work to 5 °C. A plan written to one country's figure should be checked in the other.
Shorter allergen list
The Food Regulations name 5 groups: gluten cereals, nuts including peanut and soybean, fish, milk and egg. Singapore names 8, and the shared Australian and New Zealand Code has its own list. A label can't simply move across.
Pork and halal
Pork-origin food can't share a storage facility with non-pork food (reg 38). Halal claims are controlled by law. Both shape kitchen layout.
Local grades vary
Local authorities grade premises and the method varies by council. One published example starts at 100 points, deducts for each breach and awards A, B or C by band. The by-laws were not read, so treat this as an example, not a national scale.
Penalties
Injurious food (s 13): up to RM100,000 or 10 years, or both. Most hygiene regulations: up to RM10,000 or 2 years. Closure order: up to 14 days at a time (s 11). Directors and managers can be deemed guilty unless they show due diligence (s 33A).
